General Instructions:
You are a member of the Settlement Class and eligible to submit a Claim Form to receive Settlement benefits if you were a customer of Concord Music Group, Inc. (“Concord”) and you were notified by Concord that your name, Social Security number, and financial account information (“Personal Information”) were potentially compromised in a cyberattack against Concord (the “Cyberattack”). The deadline to submit a Claim Form is July 3, 2025.
Excluded from the Settlement are:
- Concord Music Group, it’s officers and directors;
- Any Entity in which Concord has a controlling interest;
- The affiliates, legal representatives, attorneys, successors, heirs, and assigns of Concord;
- Any judges assigned to this case and their staff and family; and
- Any other person found by a court of competent jurisdiction to be guilty under the criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Security Incident or who pleads nolo contendere to any such charge.
Available Benefits:
Settlement Class Members may submit a claim form for the following benefits. You are not limited to one benefit and may claim each option for which you are eligible.
Credit Monitoring Services. All Settlement Class Members shall have the ability to make a claim for 3 years of three-credit bureau credit monitoring services and identity protection services with $1 million in identity theft insurance by correctly submitting the Claim Form. Even if Settlement Class Members previously accepted the Defendant’s offer of complimentary credit monitoring services, they may still claim this benefit.
Cash Payment. All Settlement Class Members who submit a valid and timely claim may also elect to receive a one-time payment of $70 without the need to document losses or attest to time spent as a result of the Cyberattack.
Ordinary Losses. Settlement Class Members can claim up to a total of $700 per Claimant, upon submission of a valid claim with supporting documentation for out-of-pocket losses incurred or spent between November 14, 2022, and July 3, 2025. Losses include:
- Out-of-pocket expenses incurred as a result of the Cyberattack, including bank fees, long distance phone charges, cell phone charges (only if charged by the minute), data charges (only if charged based on the amount of data used), postage, or gasoline for local travel; and
- Fees for credit reports, credit monitoring, or other identity theft insurance products purchased on or after November 14, 2022, through March 5, 2025.
Extraordinary Losses. Settlement Class Members can claim up, to a total of $7,500 per Claimant, which includes compensation for proven monetary loss, professional fees including attorneys’ fees, accountants’ fees and fees for credit repair services incurred as a result of the Cyberattack.
Lost Time Claims. Settlement Class Members who spent dealing with the Cyberattack will be compensated at a rate of $20 per hour for up to five hours, if at least one full hour was spent dealing with the Cyberattack. Claimants must attest to the accuracy of any request for compensation for lost time but are not required to submit supporting documentation.
Compensation for Ordinary Losses and Extraordinary Losses will only be paid if:
- The loss is an actual, documented, and unreimbursed monetary loss;
- The loss was more likely than not caused by the Cyberattack;
- The loss occurred between November 14, 2022, and July 3, 2025;
- You made reasonable efforts to avoid, or seek reimbursement for, the loss, including but not limited to exhaustion of all available credit monitoring insurance and identity theft insurance; and
- Documentation of the claimed losses is not “self-prepared.” Self-prepared documents, such as handwritten receipts,are, by themselves, insufficient to receive reimbursement. Claimants must submit reasonable documentation in support of their claim for out-of-pocket losses, to be evaluated by the Claims Administrator.
Note: No payment shall be made for emotional distress, personal/bodily injury, or punitive damages.
